Immigration Act 2016

New legislation affecting landlords and agents comes into effect in a few weeks times, on the 1st December 2016. This updates and amends the existing Immigration Act 2014, not least by making offences a criminal rather than a civil matter.

The main area of interest is the ability for the landlord to evict an occupier or occupiers with a notice from the Home Office rather than a court order. The procedure differs where all occupiers in a property have failed to provide acceptable documents at the point a re-check is made as opposed to some but not all of the occupiers. To this end a new Section 8 notice has been created (7b) which is a mandatory ground for possession.
