LETTING AND THE LAW: FOUNDATION

This course is aimed at all staff involved with residential lettings and provides an overview of the legal obligations placed on the agent and the landlord.
The day will cover the following topics:
- The criteria needed to make a contract rather than an agreement
- Guarantor requirements and obligations
- The impact of common law on the agent
- Unfair Terms in Consumer Contract Regulations 1999
- Cancellation of contracts made with the consumers
- Tax considerations for the overseas landlord
- Contractual and statutory obligations placed on a landlord
- Safety regulations; Discrimination
- Criteria to make a tenancy rather than a licence
- Housing Act tenancies
- Contractual tenancies including corporate let considerations
- Notices and information that must be included in tenancy agreements
- Executing the tenancy
- Basic rules for ending the tenancy for the landlord and the tenant
- Tax considerations for the overseas landlord
